BSI Refund and Returns Policy

ONLINE RETURNS AND REFUNDS POLICY
If you are not completely satisfied, you can return the BSI Merchandise (“the Goods”) to us and we will either refund, repair or replace it subject to the below terms. This Policy only applies to Goods or Services purchased from BSI via the BSI website (“the Website”) available at www.bsisports.com.
This Policy forms part of the BSI Terms and Conditions of Use, and so words defined in the Terms and Conditions of Use Agreement have the same meaning in this Policy, unless the context indicates otherwise. Nothing in this Policy is intended to limit your statutory rights in any way.
This Policy was last revised on 28 June 2021.
You are advised to regularly check the Website for any amendments or updates.
1. Preparing your Goods for a return
1.1. To ensure your request is processed as quickly as possible you are responsible for the following when returning your Goods:
1.1.1. package your Goods safely and securely for protection during transit; and
1.1.2. Include all accessories and parts that were sold with the Goods.
1.2. Failure to adhere to any of these requirements could delay the processing of your request or result in its decline altogether.
2. Unwanted products
2.1. You can return an unwanted Goods to us at no charge, provided:
2.1.1. it is undamaged and unused, with the original labels and stickers still attached;
2.1.2. save in relation to personalised and used Goods, it is in the original packaging, which must be undamaged and in its original condition with all seals still intact (if applicable).
2.1.3. it is not missing any accessories or parts;
2.1.4. you log a return via email within 30 (thirty) days of collection by you of the unwanted Goods. After 30 (thirty) days, you can only return a Goods if they are defective; and
2.1.5. it is not one of the Goods listed below.
3. Change of Mind Returns
3.1. Where you have changed your mind and would like a refund for Goods purchased, you can return them – provided the Goods are not:
3.1.1. a digital product such as an eBook, electronic voucher, gaming code or other digital download;
3.1.2. an audio or video recording or computer software that has been unsealed;
3.1.3. a newspaper, periodical or magazine;
3.1.4. a foodstuff, beverage or other product intended for everyday consumption;
3.1.5. a nursing or maternity product, an infant bottle, infant feeding product or bottle accessory that has been unsealed, including (but not limited to) breast pumps, bottles, teats, soothers/pacifiers, formula, maternity underwear, nappies and wipes;
3.1.6. a beauty product or fragrance which has been used;
3.1.7. an intimate product, lingerie, swimwear, bodysuit, underwear or jewellery for piercings, which for hygienic and public health reasons may not be returned; or
3.1.8. a product which has been personalised for you or made to your specifications; or
3.1.9. a flatpack furniture product that has been assembled after delivery.
3.2. The goods will need to be sent back at your charge. Once we have inspected the Goods and validated your return, we will process the refund of the purchase price of the Goods within 10 days of the return.
4. Incorrect Goods
4.1. Please note that it is your responsibility to inspect the Goods prior to accepting delivery. Should you accept delivery and the Goods are not as described on the Website, the goods will need to be sent back at your charge. If the Goods are missing any accessories or parts, you will need to follow the process set out below. Once we have inspected the Goods and validated your return, we will at your choice make the correct Goods available for collection to you as soon as possible (if the correct Goods are available); or refund of the purchase price of the Goods. Once we have inspected the Goods and validated your return, we will process the refund of the purchase price of the Goods within 10 days of the return.
5. Defective Goods
5.1. A defect is a material imperfection in the manufacture of a product or any characteristic of a product, which makes the product less acceptable than one would reasonably be entitled to expect in the circumstances.
5.2. The following will not be regarded as defects and will not entitle you to a return:
5.2.1. faults resulting from normal wear and tear;
5.2.2. damage arising from negligence, user abuse or incorrect usage of the Goods;
5.2.3. damage arising from electrical surges or sea air corrosion;
5.2.4. damage arising from a failure to adequately care for the Goods;
5.2.5. damage arising from unauthorized alterations to the Goods;
5.2.6. where the specifications of a Goods, although accurately described on the Website and generally fit for its intended purpose, do not suit you.
6. Standard Warranty
6.1. If you have received Goods which turn out to be defective or otherwise of poor quality, please notify us as soon as reasonably possible after you become aware of the defect or poor quality, but in any event within 6 months after collection of the Goods.
6.2. You can do so by sending us an email, and we will arrange to collect the Goods from you at no charge. Once we have inspected the Goods and validated your return, we will at your choice repair / replace the Goods (if such repair is possible / we have the same Goods are in stock to use as a replacement) or refund you the purchase price of the Goods. If the repair / replacement takes longer than 21 days, we will get in touch with you to see if you would rather receive a refund.
6.3. Where there is no extended supplier warranty period, unfortunately we cannot facilitate returns that fall outside of the 6 month period.
7.1. There are two types of Coupons: a Coupon with a fixed amount of a discount, e.g. R100 off (“Fixed Coupon”), and a Coupon with a percentage discount, e.g. 10% off (“Percentage Coupon”).
7.2. Where you have used a Fixed Coupon to pay for an order, and you or BSI later cancels your order (or part thereof) prior to delivery of the relevant product(s), or you log a return of one or more products for a refund in accordance with the Returns Policy, the value of the Fixed Coupon will be deducted off the purchase price of the cancelled or returned product(s) (as applicable), and we will refund your account for the balance, if any (or refund you if that is your preference). We will also provide you with a replacement Fixed Coupon of the same value as the original Fixed Coupon used. BSI may in its sole discretion impose restrictions on the use of the replacement Fixed Coupon.
7.3. Where you have used a Percentage Coupon to pay for an order, and you or BSI later cancels your order (or part thereof) prior to delivery of the relevant product(s), or you log a return of one or more Goods for a refund in accordance with the Returns Policy, the value of the discount received using the Percentage Coupon will be deducted off the purchase price of the cancelled or returned Goods (as applicable), and we will refund your account for the balance. We will also provide you with a replacement Fixed Coupon of the same value as the discount received using the original Percentage Coupon. BSI may in its sole discretion impose restrictions on the use of the replacement Fixed Coupon.
8.1. There is one types of bundle: a bundle consisting of Goods that either we or you (as provided on the Website) have combined together in a single bundle (“Bundle Deal“). All returns relating to bundles are subject to the terms of this Policy as read with the following provisions:
8.2. Bundle Deal – You may return a Bundle Deal as a whole or any of its component individually to us. If you qualify for a refund in respect of any component Goods, we will refund your account with the actual purchase price (after applying any applicable saving or discount) you paid for such Goods as displayed in your order history.
9. Cooling-Off Period For Electronic Transactions
9.1. Section 44 of the Electronic Communications and Transactions Act (“the ECT Act”) may apply to your electronic transactions. If you qualify as a consumer under the ECT Act, you may be entitled to cancel some electronic transactions within seven days, without reason or penalty. ‘Cancel’ means each party will be placed in the same position that they were in before the transaction took place. This means that you have to return a new, unused good, and we will refund the purchase price. Section 44 is only applicable if you are a natural person – in other words, a human being. You must also be the end user of the goods or service. The transaction must be an electronic transaction — a transaction concluded via (in whole or in part) the Website, email, or SMS.
9.2. This cooling off period does not apply to goods made or altered to your specifications, or goods specially ordered from a foreign country.
10. Return Of Goods In Terms Of Cooling-Off Period
10.1. You must return any Goods in new condition with all original packaging and materials (including any accessories or parts). We will refund the purchase price of the Goods within 30 days of the date of cancellation.
11. Charges and refunds
11.1. If you return defective Goods to us, but you fail to return all of the accessories and parts that were sold with those Goods, we are entitled to (subject to applicable law) refuse the return, or only to replace the item that you did return; or to estimate the value of the missing accessories and parts and refund you in respect of the returned item only.
11.2. If you return Goods that does not comply with this Policy, you may be liable to reimburse BSI for the cost of collecting the Goods from you and the cost of having the Goods returned to you.
11.3. Please note that we only refund to the payment method that you originally used.
